Terms & User Agreement
1. Introduction
These Terms and Conditions govern the use of the Mazadat.bid online auction platform operated by Mazadat.bid, a company incorporated in the Kingdom of Bahrain, CR No. 142030-2, Office 0003 – Building 628 – Road 1011 – Block 410. By accessing or using the Mazadat.bid website or mobile application, you agree to these Terms and Conditions.
2. User Registration and Accounts
To participate in auctions, users must register and create an account with accurate and complete information. Guests may browse the platform but cannot place bids or make purchases. Users are responsible for maintaining the confidentiality of their login credentials and all activities under their account.
3. Auction Participation
Users acknowledge that:
- All bids placed are final and binding.
- Bids cannot be retracted or modified once submitted.
- Failure to complete payment within seven (7) days of auction closing may result in account suspension and loss of access to future auctions.
- Mazadat.bid reserves the right to cancel bids suspected of fraud or abuse.
4. Payments and Refunds
Mazadat.bid acts as an intermediary to process payments on behalf of merchants. Users must complete payment for winning bids within seven (7) days. Refunds are available only if the auction or item is canceled by Mazadat.bid or if the item becomes unavailable.
5. Delivery and Logistics
Mazadat.bid manages deliveries through authorized logistics partners. Delivery times are estimated and not guaranteed. Users agree to provide accurate shipping details and accept that delays may occur beyond Mazadat.bid’s control.
6. Premium Accounts
Standard user accounts are free of charge. Premium users may subscribe to additional features and services for a monthly fee as specified on the platform. Subscription fees are non-refundable once paid.
7. Content Ownership and Intellectual Property
All content, including text, graphics, videos, live auctions, and recordings, are the exclusive property of Mazadat.bid. Users may not reproduce, copy, or distribute any content without prior written approval.
8. User Conduct and Platform Misuse
Users agree not to:
- Engage in fraudulent or misleading bidding.
- Use the platform for illegal activities.
- Post or transmit offensive, defamatory, or harmful content.
Mazadat.bid reserves the right to suspend or terminate accounts for any misuse of the platform.
9. Limitation of Liability
Mazadat.bid shall not be liable for any indirect, incidental, or consequential damages arising from user participation in auctions or interactions with merchants. Mazadat.bid acts solely as a digital intermediary.
10. Dispute Resolution
All disputes must first be reported to Mazadat.bid’s support team via support@mazadat.bid. If not resolved, disputes will be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.
11. Changes to Terms
Mazadat.bid reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms and Conditions.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain.
الشروط والأحكام واتفاقية المستخدم
١. المقدمة
تحكم هذه الشروط والأحكام استخدام منصة المزادات الإلكترونية مزادات.بد، التي تديرها شركة مزادات.بد المسجلة في مملكة البحرين برقم السجل التجاري 142030-2، مكتب 0003 – مبنى 628 – طريق 1011 – مجمع 410. باستخدامك لموقع أو تطبيق مزادات.بد، فإنك توافق على هذه الشروط والأحكام.
٢. التسجيل وحسابات المستخدمين
للمشاركة في المزادات، يجب على المستخدمين التسجيل وإنشاء حساب بمعلومات دقيقة وكاملة. يمكن للزوار تصفح المنصة فقط دون المزايدة أو الشراء. يتحمل المستخدم مسؤولية سرية بيانات تسجيل الدخول وجميع الأنشطة التي تتم من خلال حسابه.
٣. المشاركة في المزادات
يقر المستخدم بما يلي:
- جميع العطاءات المقدمة نهائية وملزمة.
- لا يمكن سحب أو تعديل العطاء بعد تقديمه.
- عدم إتمام الدفع خلال سبعة (٧) أيام من إغلاق المزاد قد يؤدي إلى تعليق الحساب وفقدان الحق في المشاركة في المزادات المستقبلية.
- تحتفظ مزادات.بد بالحق في إلغاء أي عطاء يشتبه في كونه احتياليًا أو مخالفًا.
٤. المدفوعات والاستردادات
تعمل مزادات.بد كوسيط لمعالجة المدفوعات نيابة عن التجار. يجب على المستخدم إتمام الدفع عن العطاء الفائز خلال سبعة (٧) أيام. يحق استرداد المبلغ فقط في حال إلغاء المزاد أو عدم توفر السلعة من قبل مزادات.بد.
٥. التسليم والخدمات اللوجستية
تقوم مزادات.بد بإدارة عمليات التسليم من خلال شركاء خدمات لوجستية معتمدين. تعتبر مواعيد التسليم تقديرية وغير مضمونة. يوافق المستخدم على تقديم بيانات شحن صحيحة ويقر بإمكانية حدوث تأخيرات خارجة عن إرادة مزادات.بد.
٦. الحسابات المميزة
يُتاح استخدام الحسابات العادية مجانًا. ويمكن للمستخدمين المميزين الاشتراك في ميزات وخدمات إضافية مقابل رسوم شهرية محددة على المنصة. رسوم الاشتراك غير قابلة للاسترداد بعد دفعها.
٧. الملكية الفكرية والمحتوى
جميع المحتويات بما في ذلك النصوص والرسومات والفيديوهات والمزادات والتسجيلات هي ملك حصري لمزادات.بد. لا يجوز للمستخدمين نسخ أو إعادة نشر أو توزيع أي محتوى دون موافقة خطية مسبقة.
٨. سلوك المستخدم وإساءة استخدام المنصة
يوافق المستخدم على عدم:
- الانخراط في مزايدة احتيالية أو مضللة.
- استخدام المنصة لأي أنشطة غير قانونية.
- نشر أو إرسال أي محتوى مسيء أو تشهيري أو ضار.
تحتفظ مزادات.بد بالحق في تعليق أو إنهاء الحساب في حال أي إساءة استخدام للمنصة.
٩. تحديد المسؤولية
لا تتحمل مزادات.بد أي مسؤولية عن الأضرار غير المباشرة أو العرضية أو التبعية الناشئة عن مشاركة المستخدم في المزادات أو تعامله مع التجار. تعمل مزادات.بد كوسيط رقمي فقط.
١٠. تسوية النزاعات
يجب الإبلاغ عن جميع النزاعات أولاً إلى فريق دعم مزادات.بد عبر support@mazadat.bid. وإذا لم تُحل، تُحال النزاعات إلى الاختصاص الحصري للمحاكم البحرينية.
١١. التعديلات على الشروط
تحتفظ مزادات.بد بحق تعديل هذه الشروط في أي وقت، ويُعد استمرار استخدام المنصة قبولاً للشروط والأحكام المحدثة.
١٢. القانون الواجب التطبيق
تخضع هذه الشروط والأحكام وتفسر وفقًا لقوانين مملكة البحرين.
